A worker was crushed until his head burst. That was the headline on a newspaper. The man was working on a tire forming machine. It suddenly pulled him in and crush his head to death, It is a real horrifying accident from working with uncontrolled energy. Let's see what is being "Uncontrolled"
The first part of the law is giving definition of these things Item 3 Machineries- The rest of the world knows what is machineries but Thai may not. Good thing is, mechanical tools are also counted as machineries. The other good part of this law is trying give definition about “Machine Safeguarding”. However, do not expect to see anything like, control devices, stationery guards, interlocked guards, non-interlock guards. Thai laws are not really giving any clear description or referenced global recognized standards. That is why the next part of the law in relation to machine safety is all about entanglement hazards. The employee should keep themself not to be dragged into the machine. Item 7 Seem to set a requirement about Lock Out Tag Out- LOTO or LOTOTO in some company. Thai law does not have any other set of requirement to give any guidance what is really mean by the description of this item. That is why this poor worker being crushed to dead. Thai law does not really emphasize about “Zero Energy State” or prohibition for working with energized euipment or machinery. To justify whether or not the employer comply. It is depending on very junior safety inspectors. This is totally different from what the US OSHA is doing when it comes to LOTO or machine safe guarding. Having said, machine safe guarding, do not expect to see any globally recognized standard such as “Forced To Break Contact Devices” or “ANSI” stuffs. Thai law refer to none of them. A five Bath Limit Switch may already acceptable by Thai law already. (Sorry for being too straight forward).
