Dealing with a gangster contractors

ฺBad contractors, unsafe equipment, gangster-mafia workers, is always a pain in the ass of "safety officer". Sometimes, they are a very good friend or relative of big boss here. Of course!!!, most of the case is against COC- Code of Conduct but it seems the real life COC is mean Commission of Collages. Here is how to deal with big shot contractors.

Remember, all contractors are generally are the employers who have roles to play by laws. Hence, breaking safety laws and put the employees in danger is no exception. For example, allowing workers to enter a confined space without implementing safety measures can cause legal actions 1 year in jail or 400,000 THB fine.

Long times ago, a contractor who regularly do the scaffolding jobs for a gas terminal argue with me about the condition of his scaffold. He told me that, “I have been working with this terminal manager for many years without any problems”. I said, “your scaffolds are not even close to any minimum safety standards. He asked, what standard you are looking for?  If those year there was an Occupational Safety, Health and Workplace Environmental Atc. This contractor will be in difficult because he is violating Section 23

The main contractor and the sub-contractor who are under the labour protection law are obligated to carry out
an operation on occupational safety, health and environment in the same as an Employer does.

Section 62 Any person who fails to comply with Section 22 paragraph one or Section 23 shall be penalized
with imprisonment of not more than three months or a fine not exceeding one hundred thousand Baht, or both
