Labour Protection Act

Labour Protection Act B.E. 2541 replaced the old version of Labour Laws enacted under the Notification number 103 of The Revolution Party B.E. 2515. Until that year, Thailand had never have any regulatory agent at the level of Ministry to look after Labour and Welfare matters. The Labour Protection Act. B.E. 2541 (1998) mainly focuses on the right of labor such as, wage, working hour, overtime, etc. However, there are some part of this act that is regulating the prohibition of laboring under age child, pregnant workers. The Chapter 8 which has been taken out one year before the Occupational Safety, Health and Environmental Workplace Act B.E. 2554 (2011), use to be the main part of the Labor Protection Act talks about health and safety. Therefore, many of safety related regulations still in effective are enacted by the law.

Implication

Who is Employer, who is Employee, are the important part of this act. Other wise, when there is any issue related to wage, overtime paying, or even a worker being terminated unfairly, those questions must be answered. This act require “Company Rule” to be established and communicated with employees. The law ensure fair treatment among the workers, male and female. Sexual harassment is also prohibited under this law. On Chapter 3 is clearly define what female labors are not allowed. For example, working on elevated platform more than 10 meter from ground, underground mining, handling explosives or flammable material. Under this chapter, the pregnant labor are also protected from dangerous activities such as driving vehicle, expose to vibration, manual handling weigh exceeding 15 kgs or working in a boat, vessel. Child Labor is on the Chapter 4 of this act. By law, the child younger than 15 years old can not be labored. Laboring the child younger than 18 years old require formal notification to the Labor Department. There are 13 on the list of hazardous works that are prohibited for child labor. There are also the list of workplaces that can never labor a child such as slaughter house, casino or gambling houses. Chapter 5 is all about paying that employee will get when working on normal working days, overtime and etc. Chapter 6 Minimum Wage Committee Chapter 7 Welfare Committee Chapter 8 Safety- is being taken away by newer act. Chapter 9 Supervisory This part require employer of more than 15 employee to have an employee handbook which specify basic rules such as working days, hours, leave, disciplinary rules, termination of employment, etc. Chapter 10 is all about suspension. Chapter 11 Compensation and a lot more that we usually saw on the law suit cases between workers and employers. Last Chater is Penalty. Maximum is 1 year in jail, 200,000 THB fine or both for endangering the child labors.
