If the Occupational Safety, Health and Workplace Environment and all ministerial regulations are effectively followed, serious accident will surely decreased. Here is how the laws can be implemented.
Section 8 of the OSHA Act B.E. 2554 clearly states that An Employer is required to administer, manage and operate the occupational safety, health and environment in conformity with the standards prescribed in the Ministerial Regulation. Not conforming such a section is leading to Section 53 Any Employer who violates or fails to comply with standards prescribed in the Ministerial Regulations issued under Section 8 shall be penalized with imprisonment of not more than one year or a fine not exceeding four hundred thousand Baht, or both. In most cases, when the police officers come on the scene, instead of asking who is the employer, and what was the activities before or at the time of accident, and how they did it. The police always ask who was the person who doing that? And all the time it will end up with criminal charge on some poor, workers who were standing, terrifying to see there friends who just died. They are going to be in jail for the crime that they are not intend to do. They are just work to get money for their dinner. If the OSHA Laws work properly these are the question should be asked.
